Terms of Service

Welcome to PicShapes. These Terms of Service ("Terms") govern your use of the PicShapes platform and services operated by PicShapes ("we," "our," or "us").

By accessing or using PicShapes, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our service.

Age Requirement: You must be at least 13 years old (or 16 in the EU/EEA) to use PicShapes. By using our service, you represent that you meet this requirement.

PicShapes is a distributed AI image generation platform. Users submit text prompts, and independent GPU workers process these prompts to generate images.

The service operates on a credits-based system. Users spend credits to generate images, with different quality tiers consuming different amounts of credits.

To use PicShapes, you must sign in with a Google account. You are responsible for maintaining the security of your account and all activities under your account.

• You may only create one account per person
• You must not share your account or API keys with others
• You must notify us immediately of any unauthorized account access
• We reserve the right to suspend accounts that violate these Terms

Free Credits: New users receive 100 free credits upon registration.

Credit Costs: Image generation costs vary by quality tier:

• Basic tier: 1 credit per image
• Pro tier: 3 credits per image
• Premium tier: 5 credits per image

Refunds: Credits are generally non-refundable. However, if your requested tier is unavailable and we auto-downgrade your request, you will receive a partial credit refund for the difference.

No Monetary Value: Credits have no cash value and cannot be exchanged for money.

You agree not to use PicShapes to:

• Content that violates any applicable law or regulation
• Content that infringes on intellectual property rights
• Harassment, threats, or content intended to harm specific individuals
• Impersonation of real individuals without their consent
• Malware, phishing, or other malicious content
• Automated scraping or abuse of our systems
• Circumventing rate limits or security measures

Violation of these policies may result in immediate account termination and, where appropriate, reporting to law enforcement.

PicShapes allows adult (NSFW) content with the following restrictions:

• NSFW content must be appropriately tagged when published to the gallery
• You must be of legal age in your jurisdiction to generate adult content
• Workers may decline to process NSFW requests at their discretion

If you operate as a GPU worker on the PicShapes network:

• You are an independent contractor, not an employee of PicShapes
• You must process prompts in good faith and return accurate results
• You must not retain, store, or misuse user prompts or generated images
• You must comply with the Acceptable Use and Content policies
• You may decline to process requests at your discretion
• Your reputation score reflects your reliability and performance

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law:

• We do not guarantee service availability or uptime
• We are not liable for any loss of credits, data, or generated images
• We are not liable for the quality or accuracy of generated images
• We are not liable for actions taken by independent GPU workers
• Our maximum liability is limited to the amount you paid for credits in the past 12 months

• No Warranty: We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
• AI Unpredictability: AI-generated outputs may be unpredictable, inaccurate, or not match your expectations. Results are not reviewed before delivery.
• Third-Party Workers: Images are generated by independent GPU workers. We do not control or guarantee their output quality.

By You: You may delete your account at any time from your dashboard. Upon deletion, all your data including prompts, job history, and generated images will be permanently removed.

By Us: We may suspend or terminate your account if you violate these Terms, particularly the Acceptable Use Policy. Serious violations (e.g., CSAM) will result in immediate termination and may be reported to authorities.

Effect: Upon termination, your right to use the service ends immediately. Credits remaining in your account are forfeited if termination is for cause.

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution: Before filing any claim, you agree to first contact us to attempt to resolve the dispute informally.

Jurisdiction: Any legal action must be brought in the courts located in Delaware, and you consent to the jurisdiction of such courts.

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on our website.

Your continued use of PicShapes after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you should stop using the service and delete your account.
